Public Brokerage

ICAP Patent Brokerage is recognized as the pioneer and leader in the auctioning of intellectual property assets. Since April 2006, ICAP Patent Brokerage, and its predecessor organization, Ocean Tomo Transactions, has held 25 auctions across the United States and Europe resulting in the successful transaction of hundreds of millions of dollars in IP, benefiting sellers such as individual inventors, small and mid-sized companies, large corporations, federal and government agencies, academic institutions, and investors. Designed to bring a sense of urgency and closure to IP transactions, the sealed bid platform creates a center for IP liquidity and promotes transparency for a market in which none had historically existed. Through our stringent qualification process, the ICAP Patent Brokerage sealed bid platform has become the premier forum for the open and public exchange of IP.

ICAP Patent Brokerage leverages the resources of its experienced executives to draw the widest pool of targeted buyers to our public brokerage platform and provide superior IP deal execution. Publicly-marketed IP lots are first analyzed by our in-house analytics team and, in many cases, an outside law firm. Then, in collaboration with the seller, our team produces executive summaries and, if necessary, engages a well-respected law firm to draft compelling claims charts. The compiled portfolios make up the catalog comprising the lots featured in the sealed bid. We then reach out to the patent-purchasing marketplace, announcing the sale of the technology through worldwide press releases, posting detailed diligence materials on our website, and contacting buyers directly. ICAP Patent Brokerage has an extensive network of relationships with the largest and most active buyers, including Fortune 500 companies, mid-sized and emerging technology firms, patent aggregators and NPEs. Several times a year, ICAP Patent Brokerage solicits sealed bids which are collected by a third party law firm, allowing buyers to submit offers confidentially in what is considered the fairest and most efficient IP transaction forum.
